We take the protection of Personal Data very seriously. We process your Personal Data in accordance with applicable laws, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), when applicable.

This privacy policy (the “Privacy Policy”) describes how we collect, use, and disclose your Personal Data when you utilize our various services, including, but not limited to, when you access our Website, download or access our mobile application, login to your account, shop for products on our Website, subscribe to our newsletter, submit artwork, apply for employment with us, participate in one of our training programs, access any other digital or online product, program, or service provided by us, or otherwise access, use, or purchase our goods or services, whether we gain such Personal Data through electronic, physical, or verbal means (collectively, “Services”). This Privacy Policy does not apply to information that you provide to or that is collected by any third party.

We reserve the right to change this Privacy Policy at any time. We will alert you that changes have been made by indicating the “last updated” date of the current version of the Privacy Policy at the top of the Privacy Policy. If you have registered for an account with us, we will also email you a notification that this Privacy Policy has changed. We encourage you to review this Privacy Policy from time to time to make sure that you understand how we treat your Personal Data. 

This Privacy Policy supplements and is incorporated into our Terms of Use, which may be accessed here. By accessing, registering with, subscribing to, uploading, downloading, procuring through, or otherwise using our Services, you agree to this Privacy Policy and our Terms of Use, including any updates thereto, and consent to our collection, use, retainage, disclosure, and transfer of your Personal Data as described in this Privacy Policy.

2. Collecting Personal Data: Definition, Legal Basis, Methods/Purposes/Categories; Third-Party Collections

2.1 What is Personal Data?: As used herein, the term “Personal Data” means any information relating to an identified or identifiable natural person including information that specifically identifies an individual (such as a name, address, telephone number, mobile number, e-mail address, or credit card number) and information about that individual or his or her activities that is directly linked to the individual (such are IP addresses and choices made while browsing our Website). Personal Data does not include aggregate data, which is data we collect about the use of the Services or about a group or category of services or users, from which an individual’s identity cannot be discerned and all other Personal Data has been removed. This Privacy Policy in no way restricts or limits our use of aggregate data.

2.2 Legal Basis: We generally process the information you provide to us on the legal basis of our legitimate interests in performing the function or service you requested. Where appropriate, we may rely on an alternate legal bases, such as your consent to certain types of processing.

2.3 Methods of Collection: We collect, or process, Personal Data about you and your use of the Services through various means, including when you provide such Personal Data directly to us and when we automatically collect Personal Data about you when you access, use, or interact with the Services.

The Personal Data we process is determined by the context in question: For example, it may vary depending on whether you have submitted an inquiry via our contact form, registered for our newsletter, sent us a job application or purchased a product.

Please note that we may also make Personal Data available separately to a suitable location for specific processing where appropriate, e.g. when uploading job application documents or when submitting a contact request.

2.4 Direct Collection of Personal Data: We collect your Personal Data when you provide it to us for business purposes, including, but not limited to, fulfilling your request to us, registering your account, subscribing you to our newsletter, receiving your submitted artwork, processing your job application, or responding to your inquiry or contact form. In some instances, you may be able to choose what Personal Data you provide, but sometimes we require certain Personal Data in order for you to use and for us to provide you the Services.

Categories of Personal Data we collect directly from you includes:

2.4.1 Identifiers: Such as your name, billing address, shipping address, email address, phone number, username, and password.

2.4.2 Financial Information: Such as payment information and credit card numbers.

2.4.3 Employment-related Information: If you are applying for a position with us, Personal Data may also include employment-related Information such as your work history, a background check, your educational history, and the contact information of any references.

2.4.4 Research and Survey Information: We may also ask you for additional information to help us understand you better including company revenues, number of employees, industry information, and other questions for research purposes. This information may include Personal Data and is not required to use the Services.

We ask that you not send us or disclose any sensitive Personal Data (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, sex life or orientation, criminal background, or trade union membership).

2.5 Automatic Collection of Personal Data: Our Services may also capture device and site interaction data about you automatically by utilizing background technologies, including cookies, log files, web beacons, tags, or pixels (collectively “Cookies”) when you access the Services for the purpose of improving your user experience, loading and administering the Site accurately, performing analytics on Site usage to optimize our Site, and aiding our understanding of who are users are. Examples of Personal Data we collect indirectly related to your device includes the version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.

2.5.1 Cookies: Cookies are small files or other prices of data which are downloaded or stored on your computer or other device that can be tied to information about your use of our Services (including certain third party services and features offered as part of our Services). Examples of information of this type are your IP address, the browser you are using, the operating system you are using and the pages on the Sites that you visit. Session cookies are deleted when you close your browser session. More information on how to modify your browser settings or how to block, manage or filter cookies can be found in your browser’s help file or through such websites as allaboutcookies.org. You may change your browser setting to decline the use of Cookies (though this may adversely affect your operation or use of the Services). 2.5.2 Location: We collect location data through Google Analytics when you visit the Services, such as collecting IP address location information. We also collect your mailing address and shipping address when you place an order.

2.5.3 Unique Identifiers: When you use or access the Services, we may access, collect, monitor, store on your device, and/or remotely store one or more “Unique Identifiers,” such as a universally unique identifier (UUID). A Unique Identifier may remain on your device persistently, to help you log in faster and enhance your navigation through the Services. Some features of the Services may not function properly if use or availability of Unique Identifiers is impaired or disabled.

2.5.4 Logging in Through Social Media Sites: Certain Services may allow you to log in using social media accounts, such as those available via Facebook, Twitter, and Google. When you log in to one of our Services with your social media account credentials, we collect your first name, last name, and profile photos for all social media logins, as well as gender and birthdate from Facebook logins. We use this Personal Data to help you connect and share public content with your friends and followers and to contact you via our newsletters if you opt-in.

2.5.5 Analytics: We use services like Google Analytics to help us understand how our customers use the Site. Google uses cookies to track your use of the Services. The Personal Data generated by the cookie is usually transmitted to a Google server in the USA and stored there.

Google will use this information on our behalf to evaluate and generate reports and other services related to the use of our Services. Google may create pseudonymous usage profiles of users using the data it collects. We only use Google Analytics with activated IP anonymization. This means that your IP address will be shortened by Google within member states of the European Union or in other contracting states on the European Economic Area. The full IP address is sent to a Google server in the US and shortened there only in exceptional cases. The IP address sent by the user's browser will not be merged with other data provided by Google.

2.5.6 Behavioral Advertising: We may use your Personal Data to provide you with targeted advertisements or marketing communications we believe may be of interest to you. These services are provided by Klaviyo and Google Ads. Klaviyo may anonymize your Personal Data and use such data for its own business purposes.

2.5.7 Advertising: We partner with third parties to manage our advertising on other sites. Our third-party partners may use cookies or similar technologies in order to provide you with advertising based upon your browsing activities and interests. If you have chosen to connect your account to an external third-party application, such as Facebook, or an app developed using the API, you can change your settings and remove permission for the app by changing your account settings on the third-party application.

2.5.8 Do Not Track: We do not currently employ a process for automatically responding to “Do Not Track” or DNT signals sent by web browsers, mobile devices, or other mechanisms. Depending on the browser you are using, you may be able to choose to limit certain tracking by disabling cookies in your web browser or browse in a private browsing mode.

2.5.9 Publicly Available Information: We may also collect information about you from publicly available sources. Depending on the jurisdiction in which you live, publicly available information is typically excluded from Personal Data. The information you make publicly available in any public or open forum, such as on a social network, may be considered public information and not Personal Data for the purposes of this Privacy Policy and may be collected, retained, used, and disclosed by us beyond the means and methods described in this Privacy Policy. Please be aware that any content or information you share with or provide to third parties using or related to your use of the Services is neither private nor confidential. We are not responsible for any content or information you post or share with third parties. If you do not wish for certain information to be public, please do not share it publicly.

2.6 Third Party Collection: Certain third parties may use automatic information collection technologies, including cross-site tracking technologies, to collect Personal Data about you or your device. These third parties may include, but are not limited to, your internet service provider, your web browser, your mobile service provider, your mobile device manufacturer, online advertisers, and data analytics companies. We do not control these third parties or how they collect, use, or disclose your Personal Data. As stated above, this Privacy Policy is not applicable to third party collection, use, or disclosure of your Personal Data. If you have any questions about the privacy practices of any third party, you should contact the responsible third party directly.

2.6.1 Social Media: The Site may contain links to our accounts on Facebook Twitter, Instagram, Pinterest, or other similar social networks. Clicking on any such links means that the respective social network will receive information on from which website you accessed the platform and may link that information to you or collect Personal Data. It is also possible, particularly if you are currently logged in as a user to the social network in question, that the social network will link the information and/or Personal Data it collects to your account with the social network.

3. Sharing Personal Data: Categories, Purposes

3.1 Subsidiaries, Affiliates, and Business Partners: We may share your Personal Data within our corporate group, including with our subsidiaries, parent organization, and business affiliates in accordance with this Privacy Policy and applicable law. Those entities currently include Trends International, LLC, Trends International Publishing Corporation, Total Retail Services, and Trend Global Mexico. We do so for the purposes of fulfilling your requests to us, performing our contract with you, providing better service to our customers, and managing warranty, repair, customer feedback, and customer service including responding to your requests related to this Privacy Policy.

3.2 Service Providers, Contractors, and Vendors: We may share your Personal Data with service providers and contractors to help us provide our Services and fulfill obligations to you. These service providers and contractors may include database and cloud service providers, billing systems, customer management services, payment processors, shipping companies, installation and cybersecurity services, and employee management and benefits programs.

We may disclose the Personal Data you share with us to our vendors, contractors, or service providers for a legitimate business purpose such as to process your payments, conduct a background check, or ship your products to you. We may disclose the Personal Data we collect indirectly from you with us to our vendors, contractors, or service providers for a legitimate business purpose such as for search engine optimization, Site processing, and Site performance and analytics.

3.3 Advertising: We may provide advertisements targeted to you based on the Personal Data we retain about you, such as information relevant to your current location. In some circumstances we may also sell your Personal Data to advertisers and other partners.

3.4 Asset Transfer: We may share your Personal Data with a buyer or successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us is among the assets being transferred.

3.5 Legal Requests: We may share your Personal Data when required to do so by law, court order, with a buyer or successor in the event of a merger, divestiture, restructuring, reorganization, or other legal process such as a subpoena. We generally do not disclose Personal Data unless we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. We may share your Personal Data when we believe it is necessary to comply with applicable laws, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the services or using our name, or to protect the safety of any person. This may include sharing Personal Data with other companies, lawyers, agents, or government agencies. Nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

3.6 Sharing with Consent: We may share your Personal Data at your direction or any time we have your consent to do so, including implicit and tacit consent. This includes sharing your Personal Data as we have disclosed in this Privacy Policy.

3.7 Depersonalized Information: We may share your Personal Data after it is aggregated or otherwise depersonalized such that it is no longer considered Personal Data.

4. Your Choices and Rights: Sharing Choices, U.S. Law, European Economic Area, International Transfers

4.1 Your Choices: We respect your privacy and seek to provide you with options to manage the Personal Data collected about you while you are using our Services. We abide by the privacy laws applicable to you based upon your jurisdiction.

4.2 Emails: You may opt-out of receiving marketing messages from us and any of our Affiliates by unsubscribing through the unsubscribe or opt-out link in an email, or by emailing us at the address provided below in the contact section of this Privacy Policy. We will try to comply with your request(s) as soon as reasonably practical. Please note that even if you opt-out of receiving marketing-related emails from us, we will still send you important account, purchase confirmation, and administrative messages.

4.3 Notice to California Residents: Each capitalized term used, but not defined, in this section shall have the meaning given to such term in the California Consumer Privacy Act of 2018 (“CCPA”). If you are a resident of California, you may have the right to access the Personal Information we hold about you, to ask that your Personal Information be corrected, updated, ported, or erased, and to opt out of the sale of your Personal Information, as the term is defined by the CCPA. If you would like to exercise these rights, please contact us through the means indicated at the end of this Privacy Policy. If you would like to designate an authorized agent to submit these requests on your behalf, please contact us through the means indicated at the end of this Privacy Policy.

Please note the CCPA contains certain exceptions to applicability with respect to employees, job applicants and business contacts. These rights do not apply to California job applicants, employees, or business contacts.

4.3.1 Right of Access to Specific Information: You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable Consumer request, we will disclose to you:

The categories of Personal Information we collected about you;

The categories of sources for the Personal Information we collected about you;

Our business or commercial purpose for collecting, sharing, or selling that Personal Information;

The categories of third parties with whom we share that Personal Information;

The specific pieces of Personal Information we collected about you (also called a data portability request) and provide a copy to you in an electronic or paper format; and

The categories of Personal Information, if any, we disclosed for a business purpose to a third party.

4.3.2 Deletion Request Right: You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable Consumer request, we will delete (and direct our Contractors and Service Providers to delete) your Personal Information from our (and their) records, unless an exception applies (as described below).

As permitted by CCPA we may delete your Personal Information by (a) permanently and completely erasing the Personal Information on our existing systems with the exception of archived or back-up systems; (b) de-identifying the Personal Information; or, (c) aggregating the Personal Information.

We may deny your deletion request if retaining the information is necessary for us or one of our Contractors or Service Providers to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Debug products to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal, regulatory or law enforcement obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

4.3.3 Exercising Access, Data Portability, Correction, and Deletion Rights: To exercise the access, data portability, and deletion rights described above, please submit a verifiable Consumer request to us by calling using the contact information at the end of this Privacy Policy. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable Consumer request related to your Personal Information. You may only make a verifiable Consumer request for access or data portability twice within a 12-month period. To be verifiable, the Consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative of that person; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm that the Personal Information relates to you. Making a verifiable Consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable Consumer request to verify the requestor's identity or authority to make the request.

Upon receiving a data access, correction, data port or deletion request from you, we will verify your identity based on the information we have on file for you. Upon verification of your identity, we will proceed to process your request (subject to the exceptions stated above).

We endeavor to confirm receipt of your request within ten (10) days of receiving it. We will respond to a verifiable Consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional forty-five (45) days), we will inform you of the reason and extension period in writing.

We will deliver our written response via email to the email address associated with you or, if we are unable to determine your email address, via mail.

Any disclosures we provide will only cover the 12-month period preceding the verifiable Consumer request receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable Consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

4.3.4 Non-Discrimination: We will not discriminate against you simply for exercising your rights under the CCPA.

4.4 Notice to Nevada Residents: If you are a Nevada resident who wishes to exercise your sale opt-out rights under Nevada Revised Statutes Chapter 603A you may submit a request to the contact information listed at the end of this Privacy Policy.

4.5 Notice to Residents of Non-U.S. Countries: Our headquarters is in the United States. The Personal Data we or our service providers and contractors collect may be stored and processed in servers within or outside of the United States and certain Personal Data may be accessible by persons or companies outside of the United States who provide services for us. As such, we and our service providers and contractors may transfer your Personal Data to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. We will take reasonable steps to ensure that your Personal Data receives an adequate level of protection in the jurisdictions in which we process it.

If you are a resident of a country other than the United States, you acknowledge and consent to our collecting, transmitting, transferring, processing, storing, and otherwise using your Personal Data outside of the country in which you reside. Your acceptance of this Privacy Policy or use of our Site or Services constitutes consent, either express, implied, or tacit, to collect, use, and share your Personal Data as indicated herein.

4.6 Notice to Residents of the European Union and United Kingdom: If you are a resident of the European Union or the United Kingdom (also referred to as a “Data Subject”), the General Data Protection Regulation (“GDPR”) provides you with additional rights regarding our use of your Personal Data, as defined by GDPR. This section is provided pursuant to the GDPR. Each capitalized term used, but not defined, in this section shall have the meaning given to such term in the GDPR. This section describes how we collect, share, disclose, and process the Personal Data of residents of the European Union and United Kingdom.

4.6.1 Rights of European Union and United Kingdom Residents: If you are located in the European Union or the United Kingdom, you have certain rights regarding the Personal Data that we maintain about you, which in certain circumstances you will be able to exercise. The rights are as follows:

  • Access: You may request a copy of the Personal Data we maintain about you.
  • Portability: If we maintain your Personal Data based on your consent or so that we can enter into or perform under a contract with you, you have the right to obtain your Personal Data from us that you consented to give us, that is necessary to enter into or perform the contract, or that is necessary to provide member benefits to you. We will give you your Personal Data in a structured, commonly used and machine-readable format.
  • Correction: If you believe your Personal Data is incorrect, you may request that we correct, amend or delete your Personal Data that is inaccurate or incomplete.
  • Deletion or Restriction of Processing: You may request that we erase or restrict the processing of your Personal Data.
  • Object to Processing: You may object to the processing of your Personal Data in certain circumstances when we process your Personal Data for the purposes of our legitimate interests.
  • Right to Complain: You have the right to file a complaint with a supervisory authority, in particular in the European member state of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of your Personal Data infringes upon your rights.
  • Withdraw Consent: If we are processing your Personal Data based on your consent to do so, you may withdraw that consent at any time.

Some of these rights can be exercised online via your account. For example, you can review and modify certain information relating to your use of our Services and unsubscribe to email messages. 4.6.2 Collection of Personal Data: We collect Personal Data that is reasonably necessary for us to provide our Services. Subject to applicable exceptions, we will obtain your consent before collecting, using and disclosing your Personal Data for the specified purposes. In addition to circumstances in which you consent to the use of your Personal Data, the Personal Data we collect may be used or processed where we have a legitimate interest in or other legal basis for processing such data.

The categories of your Personal Data we collect and the purposes for which we collect such Personal Data are indicated above in the section entitled “Collecting Personal Data.” If we use Personal Data in ways other than described in this Policy, we will provide you with specific notice at the time of collection.

4.6.3 Sharing Personal Data: The ways in which we share your Personal Data and the purposes for which we share it are indicated above in the section entitled “Sharing Personal Data.” If we use Personal Data in ways other than described in this Policy, we will provide you with specific notice at the time of collection.

4.6.4 Processing Personal Data: We only process Personal Data when we have a legal basis to do so including:

  • When you have consented to the processing of your Personal Data, including processing your Personal Data consistent with this Policy, including the advertising purposes disclosed in this Policy;
  • When processing is necessary to perform our obligations to you or fulfill a request you have made to us;
  • When processing is necessary to comply with a legal obligation that applies to us; or
  • When processing is necessary for purposes that are in our legitimate interests and you have given any required explicit or implicit consent to such processing, including protecting the security of our Services, improving the functioning of our Services, or providing you with information about products in which you have expressed interest.

If we need to process your Personal Data to fulfill our obligations to you, failure to provide that Personal Data will mean that we cannot perform our obligations. If we collect your Personal Data for one purpose and need to process it for second purpose, we will provide you with additional information regarding this secondary purpose to ensure fair and transparent processing before we engage in further processing. Collecting and processing your Personal Data to create both general and targeted advertising is a primary purpose for collecting your Personal Data.

5. General Disclosures

5.1 Retention: When you access our Services, we will retain your Personal Data as long as it is necessary for the processing purpose in question or in accordance with our data retention policy. We determine the appropriate retention period based on the nature and sensitivity of the Personal Data being processed, the risk of harm due to unauthorized access versus the benefit of retention, and whether we can achieve the purposes of processing through other means. We may retain your Personal Data for longer periods if required by law, if you give us your permission, or in case of a legal dispute in which your Personal Data may be used as evidence.

5.2 Automatic decision-making: We do not profile or use automated decision making.

5.3 Telephone Monitoring: As part of our customer service assurance practice, telephone conversations over phones may be monitored or recorded as a part of normal business operations. Monitored or recorded calls will be used for quality assurance and training purposes.
